Terms of service

These Terms govern your use of amoracasa.com and any purchase you make from it. Please read them before placing an order.

1. Agreement

These Terms of Service form an agreement between you and Amora Casa ("we", "us", "our"), operator of amoracasa.com. By accessing the site, browsing it, or placing an order, you accept these Terms in full. If you do not accept them, please do not use the site.

Our Privacy Policy, Shipping Policy, Return & Refund Policy, Payment Policy, Cookie Policy and Disclaimer are incorporated into these Terms by reference.

2. Eligibility

You must be at least 18 years old, or the age of majority in your state of residence, to place an order. By ordering, you confirm that you meet this requirement and that all information you provide is accurate.

You may not use our products or the site for any unlawful purpose or in breach of any applicable law.

3. The Store

Amora Casa sells home decor online to customers in the United States. We reserve the right to refuse service to anyone, to limit quantities, and to discontinue any product at any time.

We may modify or withdraw the site or any part of it without notice. We are not liable if the site is unavailable at any particular time.

4. Product Information and Accuracy

We aim to describe and picture our products accurately, but we do not warrant that descriptions, images, dimensions, colours or other content are complete, current or error-free.

Colours in particular vary between screens and under different lighting. Natural materials — wood, stone, ceramic, rattan, linen — vary between pieces by their nature. Small variations in grain, tone and finish are characteristic of these materials and are not defects.

Dimensions and weights are approximate and given for guidance.

5. Pricing and Errors

All prices are shown in US Dollars (USD) and are exclusive of sales tax, which is calculated at checkout.

Prices are subject to change without notice. Despite our efforts, products may occasionally be listed at an incorrect price. Where an item is listed at an obviously incorrect price, we reserve the right to cancel the order and refund it in full rather than fulfil it at the erroneous price. We will contact you before doing so.

6. Orders and Acceptance

Your order is an offer to purchase. Our order confirmation email acknowledges receipt but does not by itself constitute acceptance. Acceptance occurs when the order is dispatched.

We may refuse or cancel any order, including where a product is unavailable, where a pricing or description error is identified, or where we suspect fraud or unauthorised use of a payment method. Where we cancel an order you have paid for, we refund it in full.

7. Accounts

If you create an account, you are responsible for keeping your credentials confidential and for all activity under your account. Notify us immediately of any unauthorised use.

We may suspend or terminate an account that we reasonably believe has been used in breach of these Terms.

8. Payment

Payment is taken in full at the time of order. Accepted payment methods, currency, security arrangements and the treatment of failed payments are set out in our Payment Policy.

You warrant that any payment method you use is lawfully yours to use and that the billing information you supply is accurate.

9. Shipping and Delivery

We ship to addresses within the United States, including all fifty states and the District of Columbia. Shipping is free on every order with no minimum spend.

Delivery normally takes 4–12 business days in total, comprising 1–2 business days of processing and 3–10 business days in transit. These are estimates, not guarantees, and delivery times may be affected by circumstances outside our control.

10. Returns and Refunds

You may request a return within 30 days of delivery, subject to the conditions in our Return & Refund Policy. We do not offer exchanges. That policy forms part of these Terms.

11. Risk and Title

Risk of loss or damage passes to you when the goods are delivered to the address you provided. Title passes when we receive payment in full.

12. Third-Party Tools and Links

The site may provide access to third-party tools and may link to third-party sites over which we have no control. We provide these on an "as is" basis without warranty of any kind and accept no liability arising from your use of them.

Your dealings with any third party are between you and that third party. Review their terms and policies before engaging with them.

13. User Contributions

If you submit comments, suggestions, reviews, photographs or other material to us, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce and publish that material in connection with our business.

You agree not to submit material that is unlawful, defamatory, obscene, infringing of another person's rights, or that contains malicious code. We may remove any submission at our discretion and are under no obligation to monitor submissions.

14. Prohibited Uses

You may not use the site or its content:

• For any unlawful purpose, or to solicit others to perform unlawful acts
• To violate any regulation, rule, law or local ordinance
• To infringe upon our intellectual property rights or those of others
• To harass, abuse, insult, harm, defame, slander, disparage, intimidate or discriminate
• To submit false or misleading information
• To upload or transmit viruses or any other malicious code
• To collect or track the personal information of others
• To spam, phish, pharm, pretext, spider, crawl or scrape
• To interfere with or circumvent the security features of the site

We may terminate your use of the site for breach of any of the above.

15. Intellectual Property

All content on this site — text, images, layout, graphics, logos and the Amora Casa name — is our property or that of our licensors and is protected by intellectual property law. You may not reproduce, distribute or create derivative works from it without our written permission.

16. Disclaimer of Warranties

Except as expressly stated in these Terms and as required by applicable law, our products and the site are provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including implied warranties of merchantability and fitness for a particular purpose.

We do not warrant that the site will be uninterrupted, timely, secure or error-free, or that results obtained from its use will be accurate or reliable.

Nothing in these Terms excludes or limits any warranty or right that cannot lawfully be excluded or limited.

17. Limitation of Liability

To the maximum extent permitted by law, Amora Casa and its officers, employees, agents and suppliers shall not be liable for any indirect, incidental, punitive, special or consequential damages, including loss of profits, loss of data or loss of goodwill, arising from your use of the site or any product purchased from it.

Where liability cannot be excluded, our total aggregate liability shall not exceed the amount you paid for the product giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions our liability is limited to the maximum extent permitted by law.

18. Indemnification

You agree to indemnify and hold harmless Amora Casa and its officers, employees, agents and suppliers from any claim or demand, including reasonable legal fees, arising from your breach of these Terms or your violation of any law or the rights of a third party.

19. Severability

If any provision of these Terms is found to be unlawful, void or unenforceable, that provision shall be severed and shall not affect the validity and enforceability of the remaining provisions.

20. Termination

These Terms remain in effect unless and until terminated by either you or us. You may terminate by ceasing to use the site. We may terminate at any time, without notice, if you breach any provision, and you will remain liable for all amounts due up to that date.

21. Entire Agreement

These Terms, together with the policies referenced in section 1, constitute the entire agreement between you and Amora Casa and supersede any prior agreements or understandings.

Our failure to exercise or enforce any right or provision does not constitute a waiver of that right or provision.

22. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Nebraska, United States, without regard to its conflict of law provisions. Any dispute shall be subject to the exclusive jurisdiction of the courts located in Nebraska.

23. Changes to These Terms

We may update these Terms at any time. The current version is always posted on this page and the date at the top shows when it was last revised. Your continued use of the site after changes are posted constitutes acceptance of the revised Terms.
